General Terms and Conditions Airsoft-Inventory
In this document you will find the General Terms and Conditions of Airsoft-Inventory. Initially, Airsoft-Inventory rejects all General Terms and Conditions of other Parties, unless otherwise determined by Agreement or in these General Terms and Conditions. You can also not derive any other rights than stated in these General Terms and Conditions.
1. Company details
Airsoft-Inventory is located at Laan van ouderzorg 118 in Leiderdorp, postcode 2352 HZ . Airsoft-Inventory is registered with the Chamber of Commerce under number 70263191.

2. Definitions

- General terms and conditions: terms and conditions as referred to in this document;

- Day: calendar day;
-
- Service: service as offered by Airsoft-Inventory and decided upon in Agreement;
-
- Digital content: data produced and supplied in digital form;
-
- Seller: Airsoft-Inventory as shown in article 1 ;
-
- Consumer: any natural person who purchases a Service from Airsoft-Inventory, under
natural person is also understood to mean: ' anyone who does not purchase a Service acting
from profession or business ';

- Product: goods as indicated on the Airsoft-Inventory website, intended for
sales. This includes Airsoft related accessories;
-
- Agreement: any Agreement concluded, regardless of the manner in which it is concluded, between Airsoft-
Inventory and Customer or Practitioner and Customer is established;
-
- Parties: Airsoft-Inventory and Customer together referred to;
-
- Written communication: all communication that does not take place verbally, i.e. digital
communication also applies under this formulation.
3. Applicability
-
The General Terms and Conditions of Airsoft-Inventory apply to every Agreement between Airsoft-Inventory and Customer. General Terms and Conditions of any other Party are rejected in principle. Only if the Parties have expressly agreed to this in writing, the General Terms and Conditions of Airsoft-Inventory do not apply.

If one or more provisions of these General Terms and Conditions are deviated from in any way, the other provisions will remain valid.

Any changes to these General Terms and Conditions agreed in writing shall only apply to the cases specified in that specific Agreement.

The General Terms and Conditions do not need to be explicitly agreed upon again after the first acceptance, but are deemed to have been tacitly accepted. This applies to all further Agreements between Airsoft-Inventory and Customer.
4. Offer quotation

Airsoft-Inventory makes an offer on the website.
-
The offer is without obligation. Airsoft-Inventory has the right to change the offer.
-
The offer as described on the website is accepted after the Customer has paid in one of the indicated ways.
-
Prices quoted on the website include VAT.
-
Images of products are a true representation of the products offered.
Airsoft-Inventory cannot guarantee that the displayed colours exactly match the real colours of the products.
5. Agreement
-
The Agreement between Airsoft-Inventory and Customer is concluded by offer and acceptance ( article 6:217 Dutch Civil Code ). The Agreement can only be concluded in writing .

A confirmation of the Agreement will always be sent to the Customer by email.
-
Changes and/or additions to the Agreement are not possible.

Assessment of the question whether Airsoft-Inventory has failed to comply with one or more
obligations (from the Agreement) is to Airsoft-Inventory. After all, all activities are performed on the basis of data provided by the Customer.
6. ExecutionAgreement
-
Airsoft-Inventory guarantees that a delivered Product complies with the Agreement. The assessment of whether the Products delivered by Airsoft-Inventory comply with the Agreement is up to Airsoft-Inventory.

Airsoft-Inventory will always exercise due care when executing the Agreement.
7. Prices
-
The price for the Products to be delivered is the price stated on the Airsoft-Inventory website or the Airsoft-Inventory offer.
-
Airsoft-Inventory reserves the right to change prices displayed on the website.
-
Delivery prices depend on the Products purchased.
-
Prices on the website include VAT.
-
Shipping costs are not included in the price, the Customer can see these upon payment.
8. Payment terms
Airsoft-Inventory requests a direct payment via IDEAL or credit card. Payment is seen as acceptance and start for the production or delivery of the ordered Products.
9. Delivery
-
Before any Product purchased through the website is shipped, Customer must pay the full purchase price.
-
Shipping costs will be borne by the Customer.
-
The ordered Product will be delivered to the address specified by the Customer.
-
Delivery times are indicative.
-
Airsoft-Inventory delivers, according to Airsoft-Inventory's insights, an end product that meets the
Agreement with Customer.
10. Returns
-
If a Product has been purchased via the Airsoft-Inventory website, the Customer has the right to return the Product within a period of 14 days, without giving any reason.
-
Returns must be made to the address indicated on the website or, if available, the address indicated on the return form.

The Product must be returned unused in its original packaging. If there are labels attached to the Products, these must also be attached to the Products when returning them. If this is not the case, there is a chance that the right to a refund will lapse.

Costs for return are for the account of Customer, unless Airsoft-Inventory makes an exception. This exception is only valid if Airsoft-Inventory confirms this in writing.

Assessment of the returned Product is at the side of Airsoft-Inventory.
-
If the Product is damaged upon return or deviates in any way from the originally sent Product, the right to a refund of the purchase price will lapse, unless
damage or deviations is the original reason for return.
11. Customer obligations
-
During the Reflection Period, the Customer shall handle the Product and its packaging with care. He shall only unpack or use the Product to the extent necessary to determine the nature, characteristics and functioning of the Product. The starting point is that the Customer may only handle and inspect the Product as he would be allowed to do in a shop.

Customer is only liable for any diminished value of the Product resulting from handling the Product in a way that goes beyond what is permitted in paragraph 1.

The Customer shall bear the direct costs of returning the Products.
12. Cancellation
Airsoft-Inventory has the right to cancel the Agreement at any time, stating the reasons for this to the Customer. Cancellation by Airsoft-Inventory is possible in cases, such as force majeure, for example because the ordered Product is not in stock.
13. Intellectual property rights

All images, texts, videos or audio materials placed on the website by Airsoft-Inventory are the property of Airsoft-Inventory.

Under copyright law, it is not permitted to distribute or reproduce these works without the express written permission of Airsoft-Inventory.
-
If a work is distributed or reproduced without express written permission, this is done under penalty of a fine equal to the loss of profit/financial damage suffered.
14. Force Majeure
-
Airsoft-Inventory is not liable for damage resulting from circumstances that were not foreseeable by Airsoft-Inventory at the time of entering into the Agreement. Such circumstances include, but are not limited to: lack of raw materials, factory failure of any kind, strike, exclusion of or lack of employees, quarantine, epidemics, pandemics, natural disasters, mobilization, state of siege, state of war or war, traffic congestion at railways or lack of means of transport, traffic blockades, illness regardless of the reason or cause thereof or other unforeseen circumstances that were not known when entering into the Agreement.

Airsoft-Inventory has the right to suspend or terminate the Agreement in case of force majeure. This does not entail any right to a refund of funds.

If Airsoft-Inventory subsequently carries out a temporarily suspended part of the Agreement, the Customer shall owe the entire agreed consideration without any form of discount.

15. Conformity and warranty

Airsoft-Inventory guarantees that the Products comply with the Agreement, the specifications stated in the offer, the reasonable requirements of soundness and/or usability and the legal provisions in force on the date the agreement was concluded.

All Products delivered via Airsoft-Inventory are covered by the statutory and manufacturer's warranty.
-
The customer can only claim warranty if he/she has proof of purchase.
-
Customer cannot claim warranty if:
-
- The Customer has processed and/or repaired the delivered Products itself or has had them repaired and/or processed by third parties;
-
- Does not have proof of purchase.
16. Liability
-

Any liability, both contractual and non-contractual, (except liability resulting from intent or gross negligence) of Airsoft-Inventory and - if this should occur - its directors and employees, is limited to the amount paid at the time of purchase of the Product.
-
If Airsoft-Inventory should be liable, then this liability is limited to what is stated in this provision.
-
If Airsoft-Inventory is liable, this liability is limited to the amount determined in Airsoft-Inventory's professional and/or business liability insurance.
-
Airsoft-Inventory is not liable for damage of any kind caused by Airsoft-
Inventory is based on incorrect and/or incomplete information provided by or on behalf of the Customer
facts.
-
Airsoft-Inventory is only liable for direct damage.
-
Direct damage is understood to mean only the reasonable costs of determining the cause.
and the extent of the damage, insofar as the determination relates to damage within the meaning of these terms and conditions, any reasonable costs incurred to ensure that Airsoft-Inventory's defective performance complies with the Agreement, insofar as these can be attributed to Airsoft-Inventory and reasonable costs incurred to prevent or limit damage, insofar as the Customer demonstrates that these costs have led to a limitation of direct damage as referred to in these General Terms and Conditions.

Airsoft-Inventory is never liable for indirect damage.

Under no circumstances is Airsoft-Inventory liable for guarantees and securities given by third parties.

The limitations of liability contained in this article do not apply if the damage is
is due to intent or gross negligence on the part of Airsoft-Inventory.
17. Complaints Policy
-
Customer must report any form of complaints or comments within a reasonable period after discovery of a defective product. The term for reporting is in any case 7 Days after discovery of the defect. In this case, the term starts from the moment that Customer or Client discovers the defect or should reasonably have discovered it. Complaints or comments can be made known to Airsoft-Inventory both by telephone and by e-mail.

Airsoft-Inventory will contact you within 7 days after the complaint has been made known to discuss the complaint and further steps to be taken.

Assessment of the type of work carried out to repair the defect is always on the side of Airsoft-Inventory.

18. Privacy and Customer Data
Airsoft-Inventory complies at all times with the General Data Protection Regulation and/or related laws and regulations. See our privacy policy for more information.
19. Conversion
If and to the extent that, on the grounds of reasonableness and fairness or the unreasonably onerous nature, no appeal can be made to any provisions of the Agreement and General Terms and Conditions, the provision in question will in any case be given a meaning that is as similar as possible in terms of content and scope, so that an appeal can be made to it.
20. Aftereffects
If it is expressly or tacitly intended that provisions in these General Terms and Conditions remain in force, they will continue to apply after termination of the Agreement between the Parties.
21. Conflicting Clauses
If the General Terms and Conditions and the Agreement contain conflicting provisions, the provisions as included in the Agreement concluded between the Parties shall apply. This shall only apply if it contains an express order confirmation. In any other case, the provisions as included in these General Terms and Conditions shall apply.
22. Non-compliance with General Terms and Conditions
If Customer does not comply with the provisions of these General Terms and Conditions, Airsoft- Inventory has the right to refuse to perform further Services for Customer.
23. Applicable law
All Agreements between Customer and Airsoft-Inventory, as well as these General Terms and Conditions, are governed by Dutch law.
24. Choice of forum
The court of North Holland, location Haarlem (chamber civil cases/subdistrict) is competent to hear disputes. Nevertheless, Airsoft-Inventory has the right to submit the dispute to the competent court according to the law.
25. Amendment of the General Terms and Conditions
Taking into account possible developments of the website and the working method of Airsoft-Inventory, Airsoft-Inventory reserves the right to adapt or change these General Terms and Conditions at any time. In that case, the new General Terms and Conditions will be communicated to the Customer by amendment and will apply to every Agreement that is realized after the amendment.
26. Final provision
In all cases not provided for in these General Terms and Conditions, the Agreement will be interpreted in light of these General Terms and Conditions and in accordance with reasonableness and fairness.
